Terms of Service

1. Who you are contracting with

Forecandle is operated from Cyprus by the Forecandle team — see About. Your contract is with that operator. Contact: support@forecandle.com.

2. What Forecandle is, and is not

Forecandle is a market intelligence and decision-support tool. It ingests public news, exchange feeds, economic releases and prediction-market data, scores and clusters that flow, and presents it alongside market structure — funding, open interest, realised liquidations, a modelled liquidation heatmap and odds. It also publishes model-generated trade signals with entry, target and stop levels, and a public ledger of how those signals subsequently performed.

We also do not promise performance. The signals ledger is a measured record of what a published model said and what price then did — including the losers and the calls that expired without resolving. It is history, not a forecast of your results.

3. Accounts and security

• You must be at least 18 and legally able to enter a contract. One account per person; do not share credentials.
• Sign in with Google, or with an email address and password. Give us an address you actually control — password resets and billing receipts go there.
• You are responsible for what happens under your account, including anything done with your API keys.
• Sessions are 30-day signed tokens stored in your browser. Signing out removes the token from that browser; it is not revoked server-side, so if you believe a token or API key has leaked, revoke the key in the developer area and contact us immediately so we can rotate what needs rotating.
• We may suspend an account that is abusing the service, attacking it, or using it unlawfully.

4. Plans, billing and cancellation

There are three access levels — public (no account), free (an account) and Pro (a paid subscription). What each one includes is listed on the pricing page, and that page is the authoritative description of the current plans and prices.

• Payments are processed by Stripe. We never see or store your card number; we store only a Stripe customer id, your subscription status and the renewal date.
• Subscriptions renew automatically at the end of each period at the then-current price until you cancel. Stripe charges the payment method on file.
• Cancel any time from your account, which opens the Stripe billing portal. Cancellation stops the next renewal; your Pro access runs to the end of the period you already paid for.
• Prices are shown in US dollars and may exclude taxes, which are added where required. Applicable VAT is shown at checkout.
• If we change the price of a plan, the change applies from your next renewal and we will tell you before it takes effect. If you do not want the new price, cancel before that renewal.
• Failed payments: Stripe retries. If the subscription lapses, the account falls back to the free tier — nothing is deleted.

5. Refunds

The refund terms, including the statutory right of withdrawal for consumers in the EU, EEA and UK, are set out in full in the Refund Policy, which forms part of these terms.

6. Acceptable use

Use the product. Do not use it to break the product. Specifically, do not:

• scrape the web app, or automate access to it outside the public API, in a way that evades rate limits or degrades service for others;
• resell, sublicense or redistribute Pro-only content (real-time signal levels, gated history) to people who have not paid for it;
• attempt to breach authentication, other accounts, rate limits or plan gates, or probe our infrastructure without permission (responsible security reports are welcome — see Contact);
• present Forecandle output as your own personalised advice to someone else, or use it to give advice you are not licensed to give;
• use the service where doing so would break the law that applies to you.

7. The public API

Every account can mint API keys. A key inherits the plan of the account that owns it at the moment of the request, so a downgrade downgrades the key. Rate limits, history depth and the delayed/level-stripped public signal feed are described in the developer documentation and enforced in code.

• Commercial use is permitted on both the free and Pro key tiers — that is deliberate, and it is the main reason to build on us rather than on a vendor that charges for the privilege.
• Free-tier consumers must attribute the data visibly as "Data by Forecandle" with a link to forecandle.com. Pro-tier consumers are not required to attribute, though we appreciate it.
• If you display or redistribute Forecandle data to end users — signal levels above all — you must display the disclaimer with it. It ships in every response body (the `disclaimer` field) and on the `X-Forecandle-Disclaimer` header precisely so you cannot lose it by accident. Stripping it is a breach of these terms, and it is also the point at which you, not us, are the one publishing an unqualified trade level to your users.
• Do not use the API to reconstruct and republish the whole dataset as a substitute for the service, and do not resell raw access under another brand.
• Keys are secrets. Rotate them if they leak. We may revoke a key that is abusing the service.

8. Availability, accuracy and change

This is a young product operated by a small team. It is offered as-is and as-available, with no uptime guarantee and no service-level agreement. Data can be delayed, wrong, incomplete or missing: upstream feeds fail, venues change their APIs, connectors self-disable when a source stops returning usable data, and some panels are explicitly modelled rather than measured (the liquidation heatmap says so on its face). We may add, change, gate or remove features, including ones you currently use. If we retire something you are paying for, you can cancel and, where you have paid for a period you can no longer use, ask for a pro-rata refund.

9. Third-party data and affiliate links

Much of what you see originates with third parties — news publishers, exchanges, prediction markets, data providers and public agencies. We do not control it, we do not warrant it, and their terms govern their own services. Links out are links out.

Forecandle earns affiliate commission when you open an exchange account through a "Trade …" referral link and trade there. That is disclosed in visible text next to every one of those links, it costs you nothing, and it does not change what the engine says: signals, scores and rankings are produced from market data before any commercial relationship is applied, and no exchange pays for placement of analysis. A referral link is a link to a market, not a recommendation to trade it.

10. Intellectual property

Forecandle's software, design, written analysis, briefings and aggregated datasets belong to us or our licensors. Your subscription is a personal, non-exclusive, non-transferable right to use the service while it is active, plus the API rights in section 7. Content you create — positions, notes, chat messages, alert rules — stays yours; you grant us only the licence needed to operate the service for you (store it, process it, show it back to you, and send it to the providers named in the Privacy Policy where a feature requires it). Screenshots and share cards may be posted publicly with attribution.

11. Disclaimer and limitation of liability

To the extent the law allows, the service is provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or that any output will be profitable. We are not liable for trading losses, missed opportunities, lost profits, or decisions you take on the basis of anything Forecandle shows you.

Where we are liable, our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these terms excludes or limits liability for intent or gross negligence, for injury to life, body or health, under applicable product liability law (Directive 85/374/EEC as implemented in Cyprus), or any other liability that cannot lawfully be excluded — and if you are a consumer, your statutory rights are unaffected by anything written here.

12. Termination

You can stop at any time: cancel the subscription and, if you want the account gone, ask us to delete it (see the Privacy Policy for what deletion covers and what we must keep for tax purposes). We may suspend or close an account for a serious or repeated breach of these terms, for abuse of the infrastructure, or where we are legally required to. If we close a paid account without cause, we refund the unused part of the period.

13. Governing law and disputes

These terms are governed by Cypriot law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory law of your country of residence and you may sue in your local courts. We name no special place of jurisdiction: where a dispute is heard is decided by the ordinary statutory rules.

14. Changes to these terms

We will update this page when the product or the law changes, and the date at the top always reflects the current version. For changes that materially affect a paid subscriber — price, plan contents, liability — we will give notice by email before they take effect, and continuing to use the service afterwards means you accept them. If you do not, cancel before the change applies.
